1. PREAMBLE
The present conditions of sale are concluded between SRL DYNAROP PRODUCTS, whose registered office is registered with the Crossroads Bank of Belgian Companies under number 0894.533.010, hereinafter referred to as Dynarop Products, and any natural person wishing to make a purchase of one or more products via the Dynarop.be website. The mere fact of placing an order for one or more products identified under the Dynarop Products trademark via the Dynarop.be website implies acceptance of the general terms and conditions reproduced below.
2. DEFINITIONS
The terms used in these terms and conditions or on the site are to be understood as follows:
- Dynarop.be: the 'www.dynarop.be' website of the Dynarop Products commercial brand on which products are presented and sold to customers.
- Customer: any individual or legal entity, legally capable of placing an order for product(s) via the Dynarop.be website.
- Product sheet: means the information (text, photos, graphics, classification system by heading, etc.) relating to a Dynarop Products commercial brand product offered for sale on the Dynarop.be site.
3. ACCEPTANCE OF CONDITIONS
The customer acknowledges having read these terms and conditions of sale and, by placing an order, expressly accepts them without reservation. Validation of the order implies acceptance of the general sales conditions.
4. PURPOSE
The customer connects to the Dynarop.be website, fills his/her shopping basket and places an order for the products he/she has chosen by browsing the site. The products purchased are paid for online using one of the solutions offered on the site. Dynarop Products confirms acceptance of the order by e-mail, and the products are delivered to the customer within 2 to 5 working days, depending on the destination.
5. ORDER
The customer fills his/her shopping basket with the product(s) he/she has chosen by browsing the site and clicking on “Add to basket”. The customer can consult or modify his basket at any time by clicking on “View basket”. The customer confirms his/her order by clicking on “Order”.
The customer logs on to the dynarop.com website to place their order. If the customer has already created an account, he/she will log in via “Log in” using his/her e-mail address and password. If, on the other hand, the customer has not yet created an account with Dynarop.be, he/she must create one via “Create an account” by completing the information requested: title, first name, surname, zip code, town, country, e-mail address, password, addresses (billing and delivery), shipping method, payment method, etc. ... . The customer must accept the terms of use to proceed with the creation of his/her account.
All information provided by the customer when entering order data is binding. Dynarop Products cannot be held responsible for any errors made by the customer in entering the details of the recipient of the order (delivery address, invoicing address, etc.), nor for any delays in delivery or the impossibility of delivering the products ordered that may result from such errors.
Upon receipt of the order, Dynarop Products confirms acceptance of the order by sending a confirmation message to the e-mail address provided by the customer when registering the order. The sale will only be concluded once the order confirmation has been sent.
Dynarop Products reserves the right to refuse or cancel any customer order, particularly in the event of payment problems.
Almost all products are in stock. If the product ordered is not or is no longer immediately available, Dynarop Products will inform the customer of the delivery date by e-mail. If the customer is not satisfied with the delivery time, he/she may choose to modify or cancel the order.
Only legally competent persons may place orders.
6. DELIVERY
Once the order has been confirmed and payment has been accepted by the organization in charge of the transaction, Dynarop Products undertakes to send the products ordered to the customer at the delivery address given, generally within 2 to 5 working days, depending on the destination.
Delivery is made according to the delivery method selected by the customer. Delivery costs are indicated in the customer's order summary. No compensation may be claimed by the customer from Dynarop Products in the event of late delivery.
On receipt of the products ordered, the customer or recipient must check that the products delivered are in good condition. In the event that one or more of the products ordered are missing or damaged, the customer or recipient must immediately, at the time of delivery, make the necessary reservations to the carrier and notify Dynarop Products via info@dynarop.be with a detailed description of the problem observed (possibly with photos).
If a parcel is not received despite several visits by the carrier (maximum three visits), it will be returned to Dynarop Products and the customer will be notified by e-mail. An additional delivery may be requested by the customer, who must bear the cost (even if the first shipment was made free of charge).
Countries outside Europe and Switzerland may be subject to customs clearance charges. Under no circumstances will Dynarop Products be liable for these costs. Dynarop Products cannot be held responsible for any taxes that may result from delivery to Switzerland or to countries outside Europe.
7. WITHDRAWAL
In accordance with the legal provisions in force, the customer has a period of 14 days from receipt of the products to exercise his right of withdrawal from Dynarop Products without having to justify his reasons or pay any penalty. In the event of exercising the right of withdrawal within the aforementioned period, only the price of the product(s) purchased will be reimbursed. The cost of returning the product(s) will be borne by the customer.
Sealed products that have been unsealed by the customer may not be returned for health and/or hygiene reasons. Returns must be made in their original condition and in full (packaging, advertising, products) to enable the goods to be remarketed, and accompanied by a copy of the purchase invoice for optimum management.
If the products are returned to Dynarop Products within the aforementioned conditions and deadlines, Dynarop Products undertakes to reimburse the sums paid by the customer, with the exception of delivery costs. In the event that the initial delivery costs were borne by Dynarop Products (in the case of an order for an amount entitling the customer to 'free shipping' or in the case of a promotion), these costs will be deducted from the amount refunded to the customer. Refunds are made within 1 month of receipt of the goods by Dynarop Products.
There is a right to cancel an order which only applies before the package is dispatched. Cancellation must be notified to us via info@dynarop.be.
8. PRICE
The price indicated on the product sheets does not include shipping costs.
The price indicated in the order confirmation is the definitive price expressed inclusive of all taxes and including VAT. This price includes the price of the products, handling, packaging and transport costs.
Dynarop Products reserves the right to modify product prices at any time. However, products are invoiced on the basis of the rates in force, and indicated on the Dynarop.be site at the time orders are registered.
9. PAYMENT
The price of the products is payable in cash by one of the means of payment proposed on the site on the day the order is placed.
Protection against fraudulent use of the means of payment used for the transaction, in particular as a result of piracy, and against any challenges to payment of the price of an order is provided by the secure bank payment center.
The order validated by the customer only becomes effective once the secure bank payment center has given its agreement to the execution of the transaction. In the event of refusal by the secure bank payment center, the order will be automatically cancelled and the customer will be informed by e-mail.
Information concerning the order is subject to automated data processing, for which the secure bank payment center is responsible. The purpose of this automated data processing is to combat credit card fraud. Failure to transmit data relating to the order prevents the transaction from being carried out and analyzed. In the event of fraudulent use of a bank card, irregular declaration or anomaly, the details relating to the order associated with this non-payment may be entered in a payment incident file.
10. LIABILITY
Dynarop Products shall in no way be held liable for any damages of any kind that may result from improper use of the products sold.
In any event, Dynarop Products' liability shall be limited to the amount of the order, and shall not be held liable for simple errors or omissions which may have occurred despite all the precautions taken in the presentation of the products. In particular, the photos on the site are provided for information purposes only. Under no circumstances may a modification of the container or content of a product be invoked in the event of a discrepancy in relation to the photo available on the site. The instructions published in the product sheets are for information only. The customer undertakes to read carefully the instructions displayed on or in the product packaging. It is this leaflet which contains the information (particularly dosages and any contraindications) that the user must follow.
The customer should bear in mind that the information, dosage and properties mentioned on this site do not replace medical advice. Under no circumstances does this information constitute a preventive or curative treatment for a given pathology. Pregnant or breast-feeding women are advised to seek their doctor's advice before taking any supplements. Dietary supplements must be kept out of the reach of children. Dynarop Products accepts no liability for any consequences arising from the use or misuse of the information provided.
This site may contain links to other Internet sites. Dynarop Products cannot be held responsible for the current or future content of these sites, nor for the content of external sites linked to the Dynarop.be site.
11. GUARANTEE
Under no circumstances may Dynarop Products be held liable for failure to comply with the regulatory and legislative provisions in force in the country of receipt. The potential liability of Dynarop Products is exclusively limited to the value of the product in question, determined at the date of sale.

12. PERSONAL DATA
The collection of personal information for the purposes of distance selling is compulsory, as this information is essential for the processing and delivery of orders. Failure to provide this information will result in non-validation of the order.
Dynarop Products complies with the Belgian law of December 8, 1992 relating to the processing of personal data, revised by the law of December 11, 1998, which takes into account the European directives of October 24, 1995. This law stipulates that the company collecting personal data must have the consent of the person concerned, that the data must be accurate and that it must be collected for a precise, clear and legal purpose. All individuals must have access to their personal data and the right to modify it. In accordance with the law, the processing of nominative customer data has been declared to the Commission for the Protection of Privacy. Customers have the right to access, modify, rectify and delete data concerning them, which they may exercise by contacting Dynarop Products.
Dynarop Products undertakes never to communicate customer details to third parties.
13. INTELLECTUAL PROPERTY RIGHTS
The texts, layouts, illustrations, photos, product sheets and other elements appearing on this site are protected by copyright and, in general, by the principles of intellectual property law. The content of the Dynarop.be website may not be copied. It may not be modified, placed on another site or published in any form without prior written authorization from Dynarop Products. This site may also contain texts, illustrations and other elements protected by third-party copyrights. Dynarop Products does not in any way and under no circumstances grant permission to use their intellectual property or that of third parties.
14. DISPUTES AND APPLICABLE LAW
In the event of difficulties in the application of the present contract, the customer and Dynarop Products reserve the right, before taking any legal action, to seek an amicable solution. Failing this, the courts of Tournai (Belgium) shall have sole jurisdiction, irrespective of the place of delivery of the products or the customer's place of residence.
Contracts and all legal relationships between the customer and Dynarop Products are subject to Belgian law.
